One of the primary tasks of the international civil presence under UN Security Council Resolution is to 'promote and protect human rights' para 11 j. Paragraph 87 of the Secretary General's report states that,. In order to fulfill the mandate the Human Rights Division there are currently 60 Human Rights Officers deployed in five regional centers and 21 field offices in Kosovo. There are also six international legal advisers working on specific human rights issues related to property, minorities, victim's advocacy, trafficking, law enforcement and forensics.
The Legal Systems Monitoring Section is made up of the Chief of Section, two international legal advisers and one national legal adviser. The Human Rights Training section consists of two international trainers and a human rights NGO co-ordinator who is the division's first national professional. The OSCE's human rights field operation in Kosovo functions in a complex political and security climate.
OSCE monitors such international bodies to the extent complaints of human rights violations are received and when the conduct of such bodies relates to other monitoring tasks such as minorities and their treatment. The Human Rights Division will also play a role in monitoring human rights issues related to the electoral process, such as politically motivated violations of the right to speech and assembly, and will assist in transmitting complaints to the Elections Complaints and Appeals sub-Commission.
The monitoring conducted by the Human Rights Division is proactive, not passive. The Division does not work simply by receiving complaints, although these still form a crucial part of its work. It has switched to more focused monitoring, conducting specific fieldwork on key issues to obtain a comprehensive picture of the situation.
The information gathered is then passed to the relevant authorities to form the basis for discussions on how problems can be addressed and the situation improved. This is a longer-term intervention strategy, in which the Division actively seeks to influence policy and practice through constructive engagement with the authorities, basing its interventions on up-to-date field assessments in target areas. Recommendations are based not only on addressing immediate issues, but on designing structures and systems that will prevent violations in the long term.
